Bebeluş din Vancouver va avea trei părinţi conform noii legi a familiei

În premieră pentru provincia canadiană British Columbia, o fetiţă în vârstă de trei luni născută la Vancouver va avea trei persoane trecute la capitolul „părinţi” din certificatul de naştere: tatăl biologic şi un cuplu de lesbiene.

Noua Lege aFamiliei din British Columbia, adoptată anul trecut, permite acest lucru, cerând un acord scris prealabil între mama care dă naştere, soţul sau partenerul ei şi, respectiv, donatorul de material biologic. Legea mai spune şi că orice litigiu în această privinţă poate fi rezolvat de Curtea Supremă.

Danielle Wiley, cea care a născut fetiţa, a semnat un astfel de acord alături de „soţia” sa lesbiană, Anna Richards, şi de tatăl biologic Shawn Kangro. Mama a declarat pentru ziarul National Post că, ajutându-se de o seringă, a folosit sperma lui Kangro pentru a rămâne însărcinată. Fetiţa născută pe 23 octombrie 2013 a fost numită Della.

Dar prima familie cu trei părinţi din Canada este din Ontario, recunoscută ca atare în 2006, când un tribunal din respectiva provincie canadiană a decis că un băieţel de cinci ani avea trei părinţi din punct de vedere legal: tatăl, mama şi partenera lesbiană a acesteia.

Decizia judecătorească din 2006 a contracarat una anterioară în respectivul proces, conform căreia Legea Copiilor din Ontario nu putea fi interpretată pentru a recunoaşte mai mult de doi părinţi în urma unei naşteri sau adopţii. Atunci, în 2003, Judecătorul David Aston spunea că a permite recunoaşterea a trei părinţi „putea deschide calea pentru pretenţii similare din partea părinţilor vitregi sau a membrilor familiei extinse… Dacă un copil poate avea trei părinţi, de ce nu şi şase sau zece? Ce-ar fi dacă toţi adulţii dintr-o comunitate sau sectă religioasă se decid să ceară drepturi similiare asupra fiecărui copil din respectiva comunitate? Dincolo de implicaţiile de politică socială, nu ar trebui ignorat nici potenţialul de creare şi chiar exacerbare a cererilor de custodie şi drept de vizitare”, spunea acesta în 2003.

Totuşi, la recurs, în 2006, alt judecător din Ontario, Justice Marc Rosenberg, a argumentat că legea existentă nu lua în considerare schimbările apărute în societatea canadiană în ceea ce priveşte statutul de părinte.

Mary Ellen Douglas, de la Campaign Life Coalition, a declarat pentru LifeSiteNews.com: „Tribunalele trebuie să înceteze să mai servească agenda homosexuală şi să ia în considerare că un copil merită un tată şi o mamă angajaţi într-o relaţie stabilă, care să favorizeze creşterea lui”.

„Atacurile la adresa celulei familiale vor duce în cele din urmă la distrugerea societăţii noastre. Unde se va trage linie în deciziile tribunalelor cu privire la părinţii multipli şi în ce mediu ne vom creşte copiii?”, s-a mai întrebat aceasta.

Liga Catolică pentru Drepturi Civile a cerut drept de intervenţie în procesul de la Curtea de Justiţie din Ontario, arătând că nu se cunoaşte încă efectul familiilor cu trei părinţi asupra copiilor. De asemenea, organizaţia a mai subliniat neclaritatea legii cu privire la cazurile în care părinţii unor astfel de copii se despart.

În mod obişnuit Life Chain are loc în prima duminică din luna octombrie, dar în acest an în majoritatea localităţile canadiene a fost devansată cu o săptămână pentru a nu se suprapune cu week-end-ul de dinaintea Zile Recunoştinţei în Canada.
